no tax can be levied for passive inaction

The recent SCOTUS decision to clarify the penalty for not buying health insurance under the Affordable Health Care Act as a tax, is an unprecedented tax on *not* taking an action. A taxable event should only be triggered by the ownership of property, the execution of an action, or some other interactive event. Forteitures for *not* taking an action are fines and penalties.
